Notice of Privacy Practices

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

Our Commitment to Your Privacy

Zeva Care, PLLC is required by law to protect the privacy of your Protected Health Information (PHI), to provide you with this Notice of our legal duties and privacy practices, and to follow the terms of the Notice currently in effect. PHI includes any information that identifies you and relates to your past, present, or future physical or mental health, care, or payment for care.

How We May Use and Disclose Your Information

We may use and disclose your PHI without your written authorization for the following operational purposes, subject to stricter state laws:

  • Treatment: To provide, coordinate, and manage your psychiatric care, including conducting telehealth visits, prescribing medications, and coordinating care within our clinical infrastructure.
  • Payment: To bill and obtain payment for your care, including verifying insurance eligibility, submitting claims, and processing payments.
  • Healthcare Operations: To support our practice's administrative and quality functions, such as system security, quality reviews, scheduling, and compliance audits.
  • Care Communications: To send you transaction-based appointment confirmations, reminders, and your secure telehealth video links.

Other Permitted Disclosures: We may disclose your PHI without authorization when required or permitted by law for public health activities, suspected abuse/neglect reporting, judicial proceedings, health oversight audits, or to avert a serious threat to health or safety.

Strict Protections for Mental Health Records

Because we provide psychiatric care in Pennsylvania, your records are protected under the Pennsylvania Mental Health Procedures Act (MHPA), and where applicable, federal substance use disorder regulations (42 CFR Part 2). Where Pennsylvania law requires explicit written consent or authorization for disclosures that HIPAA would otherwise allow without consent (such as certain treatment or payment disclosures to external entities), Zeva Care will obtain your specific written consent in compliance with PA law.

Uses That Require Explicit Authorization

Most uses and disclosures of psychotherapy notes, disclosures for marketing purposes, or any sale of PHI require your explicit written authorization. You may revoke an authorization at any time in writing, except to the extent we have already acted in reliance on it.

Your Rights Regarding Your PHI

You have the following specific rights regarding the health information we maintain:

  • Access & Copies: The right to inspect and receive an electronic copy of your medical and billing records.
  • Amendment: The right to request a correction to your records if you believe they are inaccurate or incomplete.
  • Accounting: The right to request a list of certain disclosures we have made of your PHI outside of routine treatment, payment, and operations.
  • Restrictions: The right to request restrictions on how we use or disclose your PHI. If you pay for a service entirely out-of-pocket, we must honor your request not to disclose that information to your health plan.
  • Confidential Communications: The right to request that we communicate with you via specific alternative methods or locations.
  • Breach Notification: The right to be notified promptly following any breach of your unsecured PHI.

Telehealth Operations

Zeva Care operates as a telehealth-first practice. Your video visits occur over an encrypted, HIPAA-compliant platform. The identical privacy, security, and confidentiality protections apply to your telehealth data as would apply in a physical medical clinic.

Complaints

If you believe your privacy rights have been violated, you may file a complaint with us or with the U.S. Department of Health and Human Services Office for Civil Rights (hhs.gov/ocr). Zeva Care will never retaliate against you for filing a complaint.

Changes to This Notice

We reserve the right to change this Notice and apply the revised practices to all PHI we maintain. The current version will always be accessible on our website with its active effective date.
